UTTAR PRADESH: Kanpur Special POCSO Act Court, through Judicial Official Pawan Kumar Rai, acquitted a man after finding that he was wrongly implicated in a rape and POCSO case due to defective police investigation.

The case was registered in 2021 at Bidhanoo police station after an FIR alleged that a person named Vickey had physically exploited a minor girl. But police arrested Amin Layal as the main accused without properly checking whether he was actually Vickey.

The court rejected the police claim that Amin was the accused and said the investigating officer failed to take proper steps to identify the real person during investigation.

“He simply leveled the charges against an innocent person. Such careless and defective investigation pushed an innocent person to the jail and he had to spent five years behind the bars for no offence,”

The judge said.

During trial, the victim refused to identify Amin as the accused. Her parents also told the court that they had clearly informed police at the time of arrest that Amin was not Vickey and that the wrong person had been arrested.

The victim’s mother said the real Vickey was her neighbour, a married and middle-aged man. Defence lawyer Mohd Salim also produced Amin’s school certificates, Class IX and X marksheets, Aadhaar card and bank passbook to show that Amin was not Vickey.

The defence further showed that on the date of the alleged incident, Amin was not in Kanpur but in Varanasi. During cross-examination, the investigating officer admitted that he had not conducted proper identification of Amin.

The court acquitted Amin Layal and ordered the police commissioner and district magistrate to conduct an inquiry against then police station in-charge Vinod Kumar Singh and his superior supervisor, and take stern action against them.

The court also directed Amin to submit two personal bonds of Rs 20,000 each and ordered jail authorities to release him after completing formalities.

This case shows how careless police work can destroy an innocent man’s life. One wrong arrest, no identification parade and defective investigation kept a man in jail for five years in a serious rape and POCSO case.
