Allahabad High Court ruling raises a critical question on financial disclosure in matrimonial disputes- 

Can a wife’s domestic violence case take away a husband’s right to financial privacy? 

Maintenance Case: The Allahabad High Court, through Justice Brij Raj Singh at its Lucknow bench, set aside a magistrate’s order and reopened a wife’s demand for her husband’s financial records in a domestic violence case

The case began when a woman filed proceedings under the Protection of Women from Domestic Violence Act, accusing her husband and his family of dowry harassment, assault, and financial torture. She also filed an application asking the court to direct her husband to submit his financial documents, including income tax returns

The magistrate court in Lucknow had earlier rejected this request through an order dated January 19. After this rejection, the wife approached the high court challenging the decision. 

While hearing the matter, the high court took a different approach and stated that: 

“Disclosure of income is important in cases related to maintenance and domestic violence”. 

The court further clarified that: 

“The magistrate can force the husband to give details of his income and property by issuing an order in this regard”. 

During the proceedings, the high court went a step further and called for the husband’s income tax returns from the Income Tax Department for the last two years. As per the official records, the husband, who is an architect, had an annual income between ₹4.85 lakh and ₹5.07 lakh. However, in the magistrate court, he had claimed that he was working as a labourer.

The high court also relied on the Supreme Court judgment in Rajnesh vs Neha and reinforced that husbands can be directed to submit documents revealing their income and assets. The bench also directed the husband to provide a copy of his income tax return to his wife. 

Finally, the high court quashed the magistrate’s earlier order and directed that the wife’s plea should be reconsidered afresh within six weeks

This case again highlights how legal proceedings are increasingly shifting towards mandatory financial disclosure from husbands, even at preliminary stages. While courts justify it in the name of transparency, it raises a larger question—whether men are being compelled to expose personal financial data without sufficient safeguards, thereby increasing the scope of pressure and misuse in matrimonial disputes.
