Did a family dispute destroy one man’s life for 18 months? UP court has now punished a woman after finding rape charges against her husband were false.
UTTAR PRADESH: A POCSO court in Etah, Uttar Pradesh, has convicted a 43-year-old woman for falsely accusing her husband of raping their 16-year-old daughter. Because of the false case, the husband was arrested in 2019 and remained in jail for nearly 18 months before being cleared by the court.
Special Judge Narendra Pal Rana said:
“Misuse of protective legal provisions cannot be tolerated under any circumstances”
while sentencing the woman to 30 days of rigorous imprisonment. The court also imposed a fine of Rs 500. If the amount is not paid, she will face an extra seven days in jail.
According to Additional District Government Counsel Shri Krishna Yadav, the matter began on September 4, 2019, when the woman filed a police complaint against her husband, who was then 40 years old. She accused him of raping their minor daughter.
After the complaint, police registered an FIR under IPC Section 376 and provisions of the POCSO Act. The husband was then arrested and sent to jail.
During the case, the husband filed a bail application and stated that the matter was “fabricated due to political conspiracy”. However, because serious sections were applied, his bail plea was rejected.
Later, during trial proceedings, investigation findings showed the allegations were false and linked to a family dispute. Reports said disagreements had taken place regarding the marriage of their minor daughter.
In January this year, the court acquitted the husband of all charges. After his acquittal, separate proceedings were started against the woman under Section 22 of the POCSO Act, which deals with false complaints or false information.
While convicting her, the court strongly criticised her conduct and called it “highly condemnable”. The judge said she misused strict legal provisions for personal revenge and “used her daughter as a pawn”.
The court further observed that “illiteracy cannot be cited as a defence in such serious offences.”
The case has once again raised concerns over false criminal complaints, where one accusation can send an innocent person to jail for years before truth comes out.
