KOCHI: The Kerala High Court bench of Justice Devan Ramachandran and Justice M.B. Snehalatha stressed that custody fights are harming children deeply. The case involved a dispute between parents, but the Court clearly leaned toward ensuring the father continues custody while securing the mother’s access, balancing the child’s needs.

The case started when the mother approached the High Court by filing a habeas corpus petition alleging that the children were being illegally kept by the father and seeking their custody through court intervention.

“Litigation related to custody of children invariably becomes uncontrollable because of the ego and strife between their parents – creating irreparable trauma and causing manifest toll on them.”

“Parents invariably do not understand, or pretend not to do so, the immeasurable brunt their actions have on their children.”

Highlighting ground realities, the Court said children react emotionally and cannot be judged strictly by their statements, observing:

“This is not the fault of children, but is the way their hearts and brains respond to arduous experiences.”

The Court strongly shifted focus from parents’ rights to children’s welfare, stating:

“The parent-centric evaluation of ‘child custody’ matters has to surely give way for ‘children-centric’ approach.”

At the same time, it made it clear that both parents are essential in a child’s life, saying:

“The presence of the father in the child’s life is equally unexpendable; and this is the tenet of nature.”

In an emotional moment, the Court recorded that the children were crying uncontrollably and clearly expressed that they wanted both their parents together. This deeply impacted the judges and highlighted how severely children are affected by parental disputes.

It reinforced that the role of the father is equally important and cannot be ignored, and that children deserve the presence of both parents in their lives as far as possible.

Accordingly, the Court held that the father will continue to have custody of the children, while the mother will have regular access including weekend custody and equal sharing of holidays, ensuring that the children maintain a meaningful relationship with both parents.
