Wife Left Her Husband, Yet He Still Had To Prove Desertion After 20 Years To Get A Divorce: Supreme Court Dissolves Marriage

The Supreme Court granted divorce to a husband after finding that his wife had abandoned the matrimonial relationship and the couple had remained separated since December 2005. The Court clarified that mere physical separation is not enough to establish desertion—the spouse seeking divorce must prove separation along with an intention to permanently abandon cohabitation without reasonable cause. On the evidence, the Court found desertion proved, dissolved the marriage and directed the husband to pay ₹7 lakh as permanent alimony.

However, merely showing that a wife is educated or capable of earning does not automatically defeat her maintenance claim; the court must consider her actual financial position and whether her independent income is sufficient in the circumstances.

Adulterous Wife Can’t Blame Husband Working Away From Home For Her Affairs: Madras High Court Grants Divorce To The Man

The Madras High Court granted divorce to a CRPF constable who alleged that his wife had developed an adulterous relationship while his job required him to remain away from home for long periods. The Court held that adultery is generally committed in secrecy and direct proof of sexual intercourse is rarely available; therefore, it can be established through convincing circumstantial evidence. Considering witness testimony, a photograph showing close proximity, a police complaint by the alleged paramour’s wife and other surrounding circumstances, the Court found the evidence sufficient to dissolve the marriage on the ground of adultery.
