Understand the issue

Start with facts, documents and the correct legal route

Maintenance litigation in India often runs parallel to 498A, domestic violence, divorce and custody proceedings. The core question before the court is not only what the respondent earns β€” it is what he can reasonably pay given his actual income, genuine liabilities, dependents, earning capacity and the applicant's own income and needs. A maintenance matter handled casually at the interim stage can create a financial burden that runs for years.

Your rights

A respondent in maintenance proceedings has the right to file a detailed financial affidavit, challenge the applicant's stated needs and income claims, produce evidence of the applicant's own earning capacity, seek a stay or reduction of an unreasonably high interim order, and apply for modification if circumstances change materially. Courts are required to apply structured financial disclosure after Rajnesh v. Neha (2020).

Assessment

Situations that change the legal response

No two matters follow exactly the same route. Identify where your facts fit before acting.

01

An interim maintenance application filed at the same time as a 498A or DV complaint, claiming a high monthly figure based on alleged lifestyle β€” before any income documents are on the court record.

02

An ex-parte interim order passed at a high amount within weeks of filing, before the respondent has had any real opportunity to present financial documents or a proper reply.

03

Maintenance proceedings running across multiple forums simultaneously β€” Section 144 BNSS, DV Act maintenance and HMA maintenance β€” each with its own disclosure requirements.

04

NRI respondent earning abroad. Indian courts often receive inflated income estimates with no verified foreign-income documentation. Exchange rate, actual take-home pay after taxes and cost of living abroad are frequently misrepresented.

Strategic approach

Preparation before reaction

Effective maintenance strategy means filing an honest, complete financial affidavit early β€” disclosing real income, genuine liabilities and actual expenses. Concealing income or assets is a high-risk approach that courts notice through cross-examination and third-party sources. The objective is a fair and sustainable order, not an order obtained by concealment that will be revised or executed against you.

Court journey

How the process usually develops

A clear sequence helps you prepare for each stage without losing sight of the objective.

1

Application and Notice

Maintenance may be claimed under Section 144 BNSS, the Domestic Violence Act or applicable matrimonial law, depending on the parties and pending proceedings. The forum and procedure differ. Once notice is served, the reply should disclose parallel proceedings and answer both entitlement and quantum with documents.

2

Interim Maintenance Hearing

Interim maintenance is decided quickly, sometimes on the face of the application alone. This is the most critical stage β€” a poorly handled interim hearing can lock in a high amount that is very difficult to reduce on appeal. An early, detailed reply with documents can significantly influence the interim figure.

3

Affidavit of Means

Both parties must file affidavits disclosing income, assets and liabilities, supported by salary slips, ITRs, bank statements and expense records. After Rajnesh v. Neha (2020), the Supreme Court mandated a standardised affidavit format. False disclosure in the affidavit has legal consequences.

4

Evidence Stage

Both parties lead evidence on income, needs, standard of living and earning capacity. Cross-examination of financial documents, bank statements and employer records often determines the outcome more than the initial claims.

5

Maintenance Order

The final order specifies the monthly amount, effective date and payment mode. It can be appealed. Either party can seek modification on a material change in circumstances β€” job loss, remarriage, change in income, or change in the child's custody arrangement.

Preparation checklist

Documents and evidence to organise

Preserve originals, maintain a dated chronology and avoid altering electronic material.

Share sensitive material only through an appropriate confidential channel.
Income tax returns (ITR) and Form 16 for three to five years β€” the most reliable income evidence available to both sides
Salary slips, bank statements and credit-card statements β€” actual income and spending pattern rather than declared income alone
Loan schedules, EMI obligations, rent agreements, medical expenses and insurance premiums β€” genuine liabilities that reduce available income
School fees, children's medical and activity expenses if custody is shared or contested
Evidence of the other party's earning capacity β€” employment records, LinkedIn profile, freelance income, business interest or income from family property
For NRI matters: payslips in foreign currency, tax filings in country of residence, foreign bank statements, proof of rent and cost of living abroad

Key case references

Rajnesh v. Neha

Supreme Court 2020

Comprehensive guidelines on maintenance: no overlapping orders across multiple forums for the same period, mandatory structured financial disclosure affidavit, guidelines on retroactivity and enforcement. A landmark judgment that directly governs all current maintenance proceedings.

Bhuwan Mohan Singh v. Meena

Supreme Court 2015

Interim maintenance must be decided on a rough-and-ready basis but cannot be arbitrary. Courts must have some factual foundation. Delay in deciding maintenance proceedings is itself a form of injustice to the applicant.

Shamima Farooqui v. Shahid Khan

Supreme Court 2015

The wife's earning capacity is a legitimate factor in quantum determination but must be assessed on evidence, not assumption. A working wife's income reduces β€” but does not eliminate β€” the husband's maintenance obligation in many cases.
