A maintenance matter handled casually at the interim stage can create a financial burden that runs for years.
Your rights
A respondent in maintenance proceedings has the right to file a detailed financial affidavit, challenge the applicant's stated needs and income claims, produce evidence of the applicant's own earning capacity, seek a stay or reduction of an unreasonably high interim order, and apply for modification if circumstances change materially. Courts are required to apply structured financial disclosure after Rajnesh v. Neha (2020).

Application and Notice
Maintenance may be claimed under Section 144 BNSS, the Domestic Violence Act or applicable matrimonial law, depending on the parties and pending proceedings. The forum and procedure differ. Once notice is served, the reply should disclose parallel proceedings and answer both entitlement and quantum with documents.
Interim Maintenance Hearing
Interim maintenance is decided quickly, sometimes on the face of the application alone. This is the most critical stage β a poorly handled interim hearing can lock in a high amount that is very difficult to reduce on appeal. An early, detailed reply with documents can significantly influence the interim figure.
Affidavit of Means
Both parties must file affidavits disclosing income, assets and liabilities, supported by salary slips, ITRs, bank statements and expense records. After Rajnesh v. Neha (2020), the Supreme Court mandated a standardised affidavit format. False disclosure in the affidavit has legal consequences.
Evidence Stage
Both parties lead evidence on income, needs, standard of living and earning capacity. Cross-examination of financial documents, bank statements and employer records often determines the outcome more than the initial claims.
Maintenance Order
The final order specifies the monthly amount, effective date and payment mode. It can be appealed. Either party can seek modification on a material change in circumstances β job loss, remarriage, change in income, or change in the child's custody arrangement.
