Wife Caught In 'Compromising Position' Not Enough To Prove Adultery: Patna High Court Rejects Husband's Divorce Plea

The Patna High Court refused to interfere with the rejection of a husband’s divorce plea based largely on allegations that his wife had an adulterous relationship and was once found in a “compromising position.” The Court found no evidence establishing voluntary sexual intercourse with another person and noted that the husband’s cruelty allegations essentially revolved around the unproved adultery claim. It therefore held that vague and unsupported allegations were insufficient to establish adultery or cruelty for granting divorce.

False Rape Case Filed By Ex-Girlfriend After 7-Year Consensual Relationship Over Refusal To Marry: Jharkhand High Court Quashes Case Against Man

The Jharkhand High Court quashed rape proceedings against a man after noting that the relationship between the two adults had continued consensually for more than seven years. The Court found no specific allegation that the man had no intention of marrying the woman when the promise was initially made. It held that a subsequent refusal or failure to marry cannot, by itself, convert a long consensual relationship into rape on a false promise of marriage.

Wife Left Her Husband, Yet He Still Had To Prove Desertion After 20 Years To Get A Divorce: Supreme Court Dissolves Marriage

The Supreme Court granted divorce to a husband after finding that his wife had abandoned the matrimonial relationship and the couple had remained separated since December 2005. The Court clarified that mere physical separation is not enough to establish desertion—the spouse seeking divorce must prove separation along with an intention to permanently abandon cohabitation without reasonable cause. On the evidence, the Court found desertion proved, dissolved the marriage and directed the husband to pay ₹7 lakh as permanent alimony.

Adulterous Wife Can’t Blame Husband Working Away From Home For Her Affairs: Madras High Court Grants Divorce To The Man

The Madras High Court granted divorce to a CRPF constable who alleged that his wife had developed an adulterous relationship while his job required him to remain away from home for long periods. The Court held that adultery is generally committed in secrecy and direct proof of sexual intercourse is rarely available; therefore, it can be established through convincing circumstantial evidence. Considering witness testimony, a photograph showing close proximity, a police complaint by the alleged paramour’s wife and other surrounding circumstances, the Court found the evidence sufficient to dissolve the marriage on the ground of adultery.

Infertility And Wife Hiding Her Medical History Before Marriage Is Fraud & Ground To Annul Marriage? Jharkhand High Court Answers

The Jharkhand High Court rejected a husband’s plea to annul his marriage on the ground that his wife had allegedly concealed a pre-existing medical condition affecting her ability to conceive. It also clarified that the Contract Act’s definition of fraud cannot simply be imported into matrimonial law.

Not Every Marital Dispute Is Cruelty U/S 498A: Delhi High Court Quashes FIR & DV Proceedings Against Husband And Family

The Delhi High Court reiterated that every matrimonial disagreement or ordinary family friction cannot be elevated into criminal cruelty under Section 498A IPC. Vague allegations, casual taunts and general assertions without specific acts capable of satisfying the statutory ingredients of cruelty may not justify continuing criminal proceedings. Courts have repeatedly cautioned against dragging relatives into matrimonial prosecutions through sweeping or omnibus allegations.

Husband Accused Of Bigamy After Eloping With Wife’s Cousin; Is Proof Of Saptapadi Mandatory For Such Allegation? MP High Court Answers

The Madhya Pradesh High Court examined a bigamy allegation involving a married man who had allegedly eloped with his wife’s cousin. The Court considered whether the complainant must prove the actual performance of Saptapadi to establish the alleged second marriage. The legal position is that a bigamy prosecution requires proof that the second marriage was validly solemnised through ceremonies essential under the law or applicable custom; Saptapadi is therefore not an inflexible requirement in every case if a valid marriage can otherwise be established under the applicable customary rites.
