TELANGANA: The Telangana High Court has stressed that courts should not overlook a father’s role in a child’s life merely because judicial sympathy often leans towards the mother in child custody disputes.

A Division Bench of Justice Moushumi Bhattacharya and Justice Renuka Yara was hearing a habeas corpus petition filed by father Kashyap Amboju, seeking the return of his four-year-old daughter. The father alleged that the mother brought the child from the USA to Hyderabad despite orders of the Circuit Court of Oregon and later denied him the shared parenting arrangement agreed before the US Court.

The parents had agreed to a Temporary Parenting Plan before the US Court on 10 April 2025. However, on 13 April 2025, the mother left the USA with the child and came to India. The High Court noted that this was contrary to an earlier US Court order prohibiting either parent from taking the child out of the State without the other parent's written consent or the Court's permission.

On 18 April 2025, the US Court granted sole temporary custody to the father. The mother subsequently filed proceedings under Section 498A IPC and also approached the Family Court at Hyderabad for divorce and permanent custody.

The Telangana High Court also recorded that the mother had agreed to the Parenting Plan but later violated it. It further noted that she refused to permit the father to interact with the child through video calls. The judgment also referred to false statements recorded by the US Court as having been made by the mother in parallel Indian proceedings, including a statement concerning temporary custody that contradicted the US Court’s subsequent order granting sole temporary custody to the father.

The Court made significant observations about the position of fathers in custody disputes:

ā€œIt may be stated that judicial sympathy mostly veers towards the mother in matters involving custody of children. This may be a combination of an instinctive and emotional response where Courts often overlook the contribution of a father to the child’s welfare.ā€

It further said:

ā€œThe father’s contribution extends far beyond providing mere financial support; fathers are an indivisible part of the wholeness and wholesomeness of family life.ā€

The Bench added:

ā€œAdopting a partisan approach against the father, especially where the facts do not portray him as an unsuitable or undeserving parent, results in grave injustice.ā€

The Court also rejected the mother’s argument concerning the father having a partner in the USA, holding:

ā€œThis argument is speculative and self-serving since the petitioner has not placed any hurdles in the return-path of the respondent No.4 to the USA along with the child.ā€

Considering the child's best interests, the Court held that the child needs the support, affection, and presence of both parents and cannot be deprived of her father’s love and care merely because the parents are involved in matrimonial and custody litigation.

The High Court directed the mother to return to the USA with the child and comply with the US Court orders. The father was directed to bear her travel, accommodation, food and other specified expenses. The court also restrained him from initiating penal action against her in the USA for violating the earlier court orders.

If the mother chooses not to return to the USA, she must hand over custody of the child to the father, or to his family member if he cannot personally travel to India. These directions take effect on 1 October 2026.
