UTTAR PRADESH: The Allahabad High Court has ruled that pressuring a husband to leave his aged, widowed mother can amount to mental cruelty, while granting divorce in a matrimonial dispute.

The Court examined evidence supporting the husband's allegations that his wife repeatedly pressured him to live separately from his widowed mother, who depended on him for care and support.

The matrimonial dispute arose over the husband's responsibility towards his mother and his wife's demand for separation. The husband claimed that this continuous pressure caused him mental harassment and seriously affected their married life.

While examining the evidence and witness testimony, the Allahabad High Court considered whether the wife's conduct constituted mental cruelty under matrimonial law and justified granting divorce.

The Court recognised that a husband's responsibility towards his dependent mother cannot be ignored simply because he is married. Forcing him to choose between his wife and widowed mother may cause serious mental distress.

Accordingly, the Allahabad High Court granted divorce to the husband on the grounds of mental cruelty, recognising the mental suffering caused by pressure to abandon his family responsibilities.
