The petitioner has joined investigation. The parties were acquainted with each other before the incident. Physical relation between the two took place allegedly on pretext of marriage. Petitioner is granted anticipatory bail.

 

 

JUDGEMENT

 

1. The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case F.I.R. No. 272/2015 registered under Sections 376/506 IPC at PS Dabri. Status report is on record. I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. By an order dated 22.05.2015 the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputably, the petitioner has joined the investigation since then. The parties were acquainted with each other before the incident. They are related to each other. Physical relations took place between the two on the alleged promise to marry. The prosecutrix lodged the FIR when allegedly the petitioner; and his parents declined to solemnize their marriage. There is delay in lodging the FIR.

2. Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of his arrest, he be released on furnishing personal bond in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required. The bail application stands disposed of.
