Supreme Court Protects Man Accused In Rape Case From Arrest; Grants Anticipatory Bail After Charge Sheet Filed
NEW DELHI: The Supreme Court of India has granted anticipatory bail to a man accused in a rape case, making his earlier interim protection permanent. The Court considered that the accused had cooperated with the investigation and that the charge-sheet had already been filed.
A Division Bench of Justice Satish Chandra Sharma and Justice Nongmeikapam Kotiswar Singh passed the order on 4 November 2026, while hearing a Special Leave Petition challenging the Delhi High Court's refusal to grant anticipatory bail.
The case arose from an FIR registered at Chitranjan Park Police Station, New Delhi, under Section 376 IPC and Sections 64(1), 77, 79 and 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023.
Earlier, on 31 August 2026, the Delhi High Court had rejected the accused's anticipatory bail application. He then approached the Supreme Court, which granted him interim protection from arrest on 22 September 2026.
Following the Supreme Court's interim order, the accused appeared before the Investigating Officer and cooperated with the investigation. The police later completed the investigation and filed the charge-sheet before the competent court.
However, counsel for the State and the complainant opposed the relief, stating that the accused had not provided the required passwords and access credentials for his Cloud storage and Telegram account.
They also raised concerns that material collected on his mobile phone could be circulated or shared.
After hearing both sides, the Supreme Court considered the accused's cooperation and the completion of the investigation. The Bench found sufficient grounds to continue his protection from arrest.
The Court observed:
"This Court after hearing learned counsel for the parties and taking into consideration the fact that the charge-sheet has already been filed and the petitioner has joined the investigation, is of the opinion that the interim order dated 22.09.2026 deserves to be made absolute."
Accordingly, the Supreme Court made the interim anticipatory bail order absolute, directing the accused to continue cooperating with the investigation and appear whenever called by the investigating authorities.
The Court further directed him to provide all necessary Cloud ID, Telegram and social media account credentials and passwords to the Investigating Officer.
The accused was also required to honour his undertaking not to circulate or share any material connected with the case, either on social media or with any person.
The Supreme Court disposed of the Special Leave Petition, granting continued protection from arrest subject to these conditions.
