BackGround: Sumit Kalra was a simpleton like most of us. A false case of 498A/ 406 was registered against him in PS Narnaund, Hisar. He was called to the Police Station for inquiry and was arrested on the same day disregarding the guidelines issued in Arnesh Kumar Judgment. He was later produced in court and was also remanded to Judicial Custody. Upon Bail, he started his counter-action.
Counter-Attack: Among other things like defending his case on merits, Sumit filed an application with Haryana Human Rights Commission for his arbitrary and illegal arrest. After getting replies from Superintendent of Police, Hisar, who also started departmental inquiry against the erring officer, the State Human Rights Commission was pleased to grant a compensation of Rs. 50,000/- to Sumit Kalra holding the state guilty of violating the Apex Court guidelines and arresting illegally when the accused was joining investigations.

When the chief secretary, Haryana Government and Director General of Police failed to comply with the orders of the Haryana Human Rights Commission, Sumit had to approach the commission again for execution of the order upon which the Commission was pleased to give following directions.
