Recent Amendments in Rape Laws in India

Rape laws in India have been amended yet again. Though the common understanding is that following the Public outrage on the Rape of minors in various parts of the country, only POSCO Act has been amended, that is further than the truth. The ordinance which has been promulgated has made amendments in provisions of S. 376 of IPC (Punishment for Rape: Proposed Section 64 of The Bharatiya Nyaya Sanhita, 2023), Criminal Procedure Code and Indian Evidence Act. The most prominent feature of this ordinance is that it provides the death penalty for rapists of girls below 12 years of Age. Beyond that also, many other stringent penal provisions for Rape have been promulgated with the said amendment ordinance. The President has signed the same, and it has now become the law of the land. The same will be ratified in Parliament in the coming session.

The Criminal Law Amendment Ordinance 2018 amends the following sections of the Indian Penal Code and the Code of Criminal Procedure, the Indian Evidence Act and the Protection of Children from Sexual Offences Act (POCSO).
