{"id":9495,"date":"2026-08-05T12:23:28","date_gmt":"2026-08-05T06:53:28","guid":{"rendered":"https:\/\/www.shoneekapoor.com\/legal-news\/?p=9495"},"modified":"2026-08-05T12:05:41","modified_gmt":"2026-08-05T06:35:41","slug":"498a-misuse-20-lakh-settlement","status":"publish","type":"post","link":"https:\/\/www.shoneekapoor.com\/legal-news\/498a-misuse-20-lakh-settlement\/","title":{"rendered":"498A Misuse | Wife Suppresses \u20b920 Lakh Settlement And Return Of Stridhan: Gujarat High Court Quashes FIR Against Husband\u2019s Family"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Can a wife file a Section 498A IPC case after accepting \u20b920 lakh as full and final settlement and receiving her Stridhan?The Gujarat High Court examined the timing of the FIR, suppressed facts and vague allegations against the husband\u2019s entire family.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>AHMEDABAD<strong>:<\/strong><\/em> The <strong><a href=\"https:\/\/gujarathighcourt.nic.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gujarat High Court<\/a><\/strong> has quashed a <strong><a href=\"https:\/\/www.shoneekapoor.com\/498a\/\" target=\"_blank\" rel=\"noreferrer noopener\">Section 498A IPC<\/a> <\/strong><a href=\"https:\/\/sahodar.in\/legal-safeguards-against-unfounded-first-information-reports-fir-and-complaints\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>FIR<\/strong> <\/a>against a husband and his family after finding that the complaint was based on vague allegations and was filed without disclosing an earlier settlement, payment of \u20b920 lakh and return of the wife\u2019s Stridhan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Justice P. M. Raval<\/strong> was hearing a petition filed by five accused persons seeking quashing of FIR, registered under Sections <strong>323, 498A, 506(1) and 114 of the <a href=\"https:\/\/www.shoneekapoor.com\/?s=Indian+Penal+Code\" target=\"_blank\" rel=\"noreferrer noopener\">Indian Penal Code<\/a><\/strong>, along with Sections <strong>3 and 7 of the <a href=\"https:\/\/sahodar.in\/dowry-prohibition-act-1961\/\" target=\"_blank\" rel=\"noreferrer noopener\">Dowry Prohibition Act<\/a><\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the FIR, the wife alleged that the husband and his family criticised her household work, repeatedly demanded dowry and subjected her to physical and mental cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She also alleged that she was beaten and forcibly made to drink Dettol. The complaint further claimed that the harassment continued even after her father had given cash, gold and silver jewellery, a motorcycle and a car.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Appearing for the petitioners, Advocate Tapaswi P. Raval argued that the complainant had not approached the Court with clean hands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He submitted that a settlement agreement had already been executed on March 17, 2017. Under the settlement, \u20b920 lakh was paid through four cheques of \u20b95 lakh each, and all the cheques were honoured.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners argued that the FIR was filed only after the payment was completed, with an intention to demand more money and harass the husband\u2019s family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was also submitted that the complainant\u2019s earlier case under the <strong>Protection of Women from Domestic Violence Act, 2005<\/strong>, had already been quashed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The allegation regarding a flat was also disputed. The complainant had alleged that the flat was transferred by her father. However, the petitioners produced the sale deed to show that the mother-in-law had purchased the property directly from the developer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence further argued that the FIR did not mention when the alleged incidents took place and did not explain the separate role of each accused family member.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitioners also informed the Court that the complainant\u2019s <strong>Stridhan, jewellery and other articles<\/strong> had already been returned before the settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State told the Court that apart from four statements made by the complainant\u2019s relatives, there was no statement from any independent witness showing the involvement of the petitioners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State also confirmed that the complainant\u2019s father and father-in-law had entered into a compromise and that cheques worth \u20b920 lakh had been handed over and honoured.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After examining the FIR and chargesheet, the Court found that the four statements relied upon by the prosecution were \u201cnothing but reproduction of the contents in the FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court further found that<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cthere are no independent statements supporting the allegations.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court noted that the wife\u2019s Stridhan had been exchanged on February 20, 2017, and a written settlement was entered into on March 17, 2017.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The record showed that \u20b915 lakh was paid in the name of the complainant\u2019s father and \u20b95 lakh was paid directly in the complainant\u2019s name.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The allegation concerning the flat was also found to be false from the sale deed placed before the Court. The document showed that the mother-in-law had purchased the flat directly from the developer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court considered the timing of the FIR important. It noted that<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cthe wife has lodged the complaint within 12 days of cheques being honoured worth of Rs.20,00,000\/- by suppressing the factum of settlement, as full and final settlement arrived between the parties.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also examined the complainant\u2019s conduct. It noted that she initially refused to accept notice and later failed to appear before the Court despite service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court found that the FIR had been lodged<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cby suppressing material facts, by making vague and misleading statements.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It further noted that the complaint was filed<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cwithout stating the factum of Stridhan having received back.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also found that all members of the husband\u2019s family had been included in the FIR without specific allegations showing their individual involvement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court finally held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cThus, merely on the basis of the vague allegations, the lodging of the present FIR would be abuse of process of law.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It further stated that filing the case without full and fair disclosure of material facts and by invoking the criminal machinery is nothing but abuse of process of law.Accordingly, the Gujarat High Court allowed the petition and quashed FIR&nbsp; and all consequential criminal proceedings against the petitioners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">EXPLANATORY TABLE OF LAWS AND SECTION<\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table><thead><tr><td><strong>Law \/ Section<\/strong><\/td><td><strong>What It Means<\/strong><\/td><td><strong>How It Applied in This Case<\/strong><\/td><\/tr><\/thead><tbody><tr><td><strong>Section 323 IPC<\/strong><\/td><td>Punishes a person for voluntarily causing physical hurt.<\/td><td>The complainant alleged that she had been beaten and physically mistreated.
