The Supreme Court examined the child\u2019s statement, the timing of both FIRs and the material ignored by the High Court before ending the criminal case.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>NEW DELHI<\/em>: The <strong><a href=\"https:\/\/www.sci.gov.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a><\/strong> has quashed a <a href=\"https:\/\/sahodar.in\/law-commission-of-india-report-urges-no-changes-to-age-of-consent-in-pocso-act\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>POCSO<\/strong> <\/a>case filed by a wife against her husband\u2019s sister and expressed concern over the growing practice of involving in-laws and children in criminal cases arising from matrimonial disputes.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cIt is commonplace, nay customary that in-laws are dragged in to settle scores in cases arising out of marital discord and often children are used to vilify each other\u201d, the Court observed.<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The case involved a woman accused of sexually assaulting her five-year-old nephew. The Supreme Court found that the complaint appeared to have been filed as a <strong>counterblast<\/strong> to an <a href=\"https:\/\/sahodar.in\/legal-safeguards-against-unfounded-first-information-reports-fir-and-complaints\/\" target=\"_blank\" rel=\"noreferrer noopener\">FIR <\/a>registered earlier against the complainant mother\u2019s brother.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that the <strong><a href=\"https:\/\/bombayhighcourt.gov.in\/bhc\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bombay High Court<\/a><\/strong> should not have refused to quash the FIR without properly examining the child\u2019s statement recorded under <strong>Section 164<\/strong> of the Code of Criminal Procedure and the other documents available on record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An earlier <strong>Division Bench<\/strong> of the Bombay High Court had already made a prima facie observation that the allegations appeared to lack substance. It had also noticed that the boy\u2019s statement before the Judicial Magistrate did not support the accusation made by his mother.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cIt was also specifically noticed that the statement of the victim boy recorded under Section 164 of the Criminal Procedure Code by the learned Judicial Magistrate of the First Class indicates that no assault as stated by the de-facto complainant had been occasioned\u2026The Division Bench which considered the matter ideally, ought to have looked into the records especially when another Division Bench; though in an interim order, noticed that prima facie the allegations cannot stand. In the totality of the circumstances, we are of the opinion that there is absolutely no reason why the petitioner should be subjected to a trial and the 2nd respondent \u2013 the mother, has also not entered appearance despite service having been effected\u201d, the Court observed.<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>Bench of Justice J.B. Pardiwala and Justice K. Vinod Chandran<\/strong> allowed the appeal filed by the accused woman. It quashed the FIR registered at Khadki Police Station in Pune under <strong>Section 354 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court also directed that no further proceedings should continue on the basis of the FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The accused woman was the paternal aunt of five-year-old twins, a boy and a girl. Their parents had obtained a divorce by mutual consent on September 5, 2023. The father was granted custody of both children, while the mother received visitation rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In her complaint, the mother alleged that while she was living in her <strong>matrimonial home<\/strong>, her son had repeatedly told her that his paternal aunt pulled his hand towards her breast while sleeping. She further claimed that she had personally witnessed one such incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mother alleged that she questioned the paternal aunt and informed her husband, but he did not take any action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the timing of the FIR became an important factor before the Court. Earlier on the same day, the children\u2019s father had registered another FIR accusing the children\u2019s maternal uncle, who was the mother\u2019s brother, of sexually assaulting the couple\u2019s daughter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the father\u2019s complaint, the girl disclosed after returning from her mother\u2019s house that her maternal uncle had touched her private parts whenever she visited her mother. She was then taken to <strong>Jahangir Hospital for a medical examination<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bombay High Court had itself noted that the two FIRs appeared to be counter-complaints connected with the strained relationship between the estranged husband and wife.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court further noted that the mother claimed her son had disclosed the alleged abuse while she was still residing in the matrimonial home and that she had personally witnessed an incident. Despite this, she had not raised the allegation during the divorce proceedings or at any earlier stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FIR was registered only on March 17, 2024, a few hours after the father lodged the sexual assault complaint against the children\u2019s maternal uncle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Considering the sequence of events, the <strong>Supreme Court observed that the mother\u2019s first information statement did not inspire confidence<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also referred to the interim order passed by another Division Bench of the Bombay High Court. That Bench had stayed the proceedings after finding, at the initial stage, that the complaint appeared to lack substance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More importantly, the <strong>interim order had specifically recorded that the boy\u2019s statement under Section 164 CrPC before the Judicial Magistrate First Class indicated that the assault alleged by his mother had not taken place<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite these findings, the Bombay High Court later dismissed the woman\u2019s petition seeking quashing of the FIR. It held that serious allegations had been made and that the accused should face trial because a court cannot conduct a mini trial while deciding a quashing petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court disagreed with this reasoning. It noted that although the High Court had expressed surprise at the allegations, it failed to examine the most important material on record\u2014the child\u2019s statement before the Magistrate, which did not support the allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Supreme Court clarified through its decision that the seriousness of an accusation cannot by itself justify forcing a person to face a criminal trial when the available material<\/strong>, the conduct of the parties and the timing of the complaint clearly require judicial scrutiny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court concluded that there was absolutely no reason to subject the husband\u2019s sister to a prolonged criminal trial and therefore quashed the FIR and all further proceedings arising from it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">EXPLANATORY TABLE OF LAWS AND SECTIONS<\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table><thead><tr><td><strong>LAW OR PROVISION<\/strong><\/td><td><strong>WHAT IT LEGALLY COVERS<\/strong><\/td><td><strong>RELEVANCE IN THIS CASE<\/strong><\/td><td><strong>SUPREME COURT\u2019S TREATMENT<\/strong><\/td><\/tr><\/thead><tbody><tr><td><strong>Section 354, Indian Penal Code, 1860<\/strong><\/td><td>Punishes assault or use of criminal force against a woman with the intention or knowledge that her modesty is likely to be outraged.
