{"id":926,"date":"2025-10-25T17:09:39","date_gmt":"2025-10-25T11:39:39","guid":{"rendered":"https:\/\/www.shoneekapoor.com\/legal-news\/?p=926"},"modified":"2025-10-25T17:09:40","modified_gmt":"2025-10-25T11:39:40","slug":"court-slams-mother-in-custody-case","status":"publish","type":"post","link":"https:\/\/www.shoneekapoor.com\/legal-news\/court-slams-mother-in-custody-case\/","title":{"rendered":"Supreme Court Slams Mother in Child Custody Case: \u201cYou Are Spoiling Your Child\u2019s Mind\u201d"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\"><strong><em>The Supreme Court criticized a slams mother for dragging her daughter into a parental conflict and appointed former Uttarakhand Chief Justice Ritu Bahri as mediator to resolve the custody dispute peacefully.<\/em><\/strong><\/h4>\n\n\n\n<p><em>NEW DELHI<\/em>: In a bitter child custody dispute, the <strong>Supreme Court of India<\/strong> has appointed <strong>former Uttarakhand High Court Chief Justice Ritu Bahri<\/strong> as mediator to help the warring couple find an amicable solution.<\/p>\n\n\n\n<p>The matter was heard on <strong>July 21, 2025<\/strong>, before a Bench comprising <strong>Chief Justice of India BR Gavai<\/strong> and <strong>Justice K Vinod Chandran<\/strong>, who observed that since the case involved family and emotional matters, mediation was the best course of action.<\/p>\n\n\n\n<p>The Court formally recorded in its order:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cTaking into consideration that the dispute is a matrimonial dispute, we consider it appropriate to refer the parties to mediation.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Further, the Bench noted:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cWith the consent of parties, we appoint Hon\u2019ble Ms. Justice Ritu Bahri, Former Chief Justice of High Court of Uttarakhand as Mediator. The Mediator shall consider all the issues between the parties. The fee of the learned Mediator would be decided by the Mediator in consultation with the learned counsel for the parties.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Husband\u2019s Contempt Plea and Allegations<\/h3>\n\n\n\n<p>The case reached the Supreme Court through a <strong>contempt petition<\/strong> filed by the husband, alleging that his <strong>visitation rights<\/strong>, granted earlier by a family court, were being violated.<\/p>\n\n\n\n<p>Earlier, in <strong>September 2024<\/strong>, the apex court had directed the <strong>District Legal Services Authority (DLSA), Chandigarh<\/strong>, to appoint a para-legal volunteer to ensure compliance with the father\u2019s visitation rights.<\/p>\n\n\n\n<p>During the latest hearing, <strong>Senior Advocate P.S. Patwalia<\/strong>, appearing for the husband, informed the Bench that the child had <strong>refused to meet her father<\/strong> under the influence of the mother.<\/p>\n\n\n\n<p>The lawyer submitted that the daughter had even accused the father of <strong>harassing her mother<\/strong>, and that the <strong>mother had sought \u20b91 crore<\/strong>, besides <strong>removing the father\u2019s name from the school records<\/strong>.<\/p>\n\n\n\n<p>Given the emotional nature of the matter, Patwalia argued that sending the parties for <strong>mediation<\/strong> would be more beneficial than imposing punishment on the mother. The counsel for the wife did not oppose this proposal, indicating her willingness to participate in mediation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Supreme Court\u2019s Strong Remarks<\/h3>\n\n\n\n<p>At this stage, the <strong>Chief Justice<\/strong> made sharp observations criticizing the mother\u2019s conduct and the psychological impact it could have on the child.<\/p>\n\n\n\n<p>CJI Gavai said:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cYou are unnecessarily dragging your child, spoiling the career of your child, you are spoiling her mind\u2026 come back someday.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The Court emphasized that involving children in marital battles causes lasting damage and should be avoided at all costs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mediation and Next Steps<\/h3>\n\n\n\n<p>With the consent of both parties, the Supreme Court appointed <strong>Justice Ritu Bahri<\/strong> as the mediator to facilitate a resolution between the couple.
