During the hearing, the accused appeared before the court through video conferencing.

Twisha Sharma was found hanging at her in-laws’ residence in Bhopal on May 12. Following the investigation, her husband Samarth Singh and mother-in-law Giribala Singh, a former district judge, were arrested on allegations related to dowry harassment, mental cruelty and domestic violence.

The CBI informed the court that voice samples of both accused were important for the investigation. According to the agency, the accused had earlier agreed to provide samples but later did not cooperate when the CBI team visited the jail on July 6.

Lawyer Ankur Pandey, representing Twisha’s family, stated that the CBI told the court that the investigation was being affected due to the absence of voice samples. He said:

“The investigation was getting hampered without the voice samples as the two accused were reluctant to provide them.”

Pandey further claimed that Giribala Singh and Samarth Singh refused to provide voice samples despite the CBI’s request. He said Giribala had provided a sample once but later refused when the team approached her again.

However, the defence lawyer Enosh George Carlo rejected the allegations and said that his clients never refused to provide voice samples. He stated:

“Despite being unwell, Giribala provided samples twice, but could not provide them the third time due to health reasons.”

Carlo also said that Giribala had requested the CBI to collect the sample on the next day. Defending Samarth Singh, he said:

“Samarth Singh is also cooperating fully with the investigation, but his objection is only to the process.”

After hearing arguments from both sides, the court allowed the CBI’s request and extended the judicial custody of Samarth Singh and Giribala Singh for 14 more days, till July 28. The investigation will continue as the agency examines the evidence collected in the case.

EXPLANATORY TABLE: LAWS AND SECTIONS INVOLVED

Law / Section

Purpose

How It Applied In This Case

Section 498A IPC – Cruelty By Husband Or Relatives

Punishes cruelty or harassment against a married woman by husband or relatives.

Applied due to allegations of dowry harassment and mental cruelty against Samarth Singh and Giribala Singh.

Section 304B IPC – Dowry Death

Covers unnatural death of a woman linked with dowry harassment within seven years of marriage.

Investigated after Twisha Sharma was found dead at her matrimonial home.

Protection of Women from Domestic Violence Act, 2005

Provides remedies against domestic abuse and cruelty.

Domestic violence allegations formed part of the investigation.

CrPC – Judicial Custody Provisions

Allows court-approved custody during investigation.

Custody was extended till July 28 for further investigation.

Forensic Evidence – Voice Sample Examination

Helps collect scientific evidence during investigation.

CBI sought voice samples, claiming they were necessary for the probe.

CASE DETAILS

Title: CBI Vs Samarth Singh & Anr.

Court: Bhopal District and Sessions Court, Madhya Pradesh

Date of Order: July 14, 2026

Counsels:

For Twisha Sharma’s Family: Ankur Pandey

For Accused Samarth Singh & Giribala Singh: Enosh George Carlo

Investigating Agency: Central Bureau of Investigation (CBI)

KEY TAKEAWAYS

Criminal investigations must remain evidence-based, and allegations alone cannot decide guilt.

Scientific evidence like voice samples must be collected through a fair legal process and examined objectively.

False implication in matrimonial disputes can harm innocent family members and must be prevented.

Courts must balance the rights of the accused with the need for a fair and complete investigation.

Every accused person deserves due process, legal protection and a fair trial until guilt is proven.

This Could Change Your Case-Get FREE Legal Advice-Click Here!

Disclaimer: The views and opinions expressed in this article are those of the Indian courts and do not necessarily reflect the official policy or position of “ShoneeKapoor.com” or its affiliates.
