Jayaprakash, has sentenced a woman and her lover to life imprisonment for murdering her husband after allegedly mixing sleeping pills in his dinner and strangling him while he was asleep.

The court held that the prosecution had successfully proved the guilt of both accused through witness statements, medical evidence, and technical records. In addition to life imprisonment, both convicts have been directed to pay a fine of ₹25,000 each, failing which they will undergo one year of simple imprisonment.

The case relates to the murder of Satish in 2017. According to the prosecution, Satish lived with his wife Kalpana in K.N. Badawan, Yeshwantpur, Bengaluru. During their marriage, Kalpana developed a relationship with Javed Pasha. On April 18, 2017, she left her home and eloped with him. Unaware of her affair or whereabouts, Satish lodged a missing person complaint with the police.

A few days later, Kalpana returned home. The prosecution stated that she and Javed believed Satish was standing in the way of their relationship and therefore planned to kill him.

As part of the conspiracy, on the night of May 22, 2017, Kalpana allegedly crushed sleeping pills and mixed them into Satish’s dinner. After he consumed the food and fell asleep, she called Javed to the house. The two then strangled Satish to death.

After the murder, Kalpana allegedly tried to make it appear that Satish had died after consuming poison. To avoid suspicion and destroy evidence, she also broke the SIM card that had been used during the commission of the crime.

The investigation was conducted by Y. Mudduraj, who was then the Inspector of Yeshwantpur Police Station. After completing the investigation, the police arrested Kalpana and Javed Pasha and filed a charge sheet before the court.

During the trial, the prosecution relied on witness testimony, medical reports, and technical evidence to prove the conspiracy and the murder. After examining the material placed on record, the court found that the prosecution had proved the charges beyond reasonable doubt.

Accordingly, the court convicted Kalpana and Javed Pasha and sentenced both of them to life imprisonment along with a fine of ₹25,000 each, with one year of simple imprisonment in default of payment of the fine.

EXPLANATORY TABLE: LAWS AND SECTIONS INVOLVED

Law/Section

Purpose

How It Applied in This Case

Section 103, Bharatiya Nyaya Sanhita, 2023 (Earlier Section 302 IPC)

Punishes the offence of murder.

The accused were convicted for intentionally murdering Satish after drugging and strangling him.

Section 61, Bharatiya Nyaya Sanhita, 2023 (Earlier Section 120B IPC)

Punishes criminal conspiracy to commit an offence.

The wife and her lover allegedly planned the murder together.

Section 238, Bharatiya Nyaya Sanhita, 2023 (Earlier Section 201 IPC)

Punishes destruction of evidence or giving false information to screen an offender.

The accused allegedly destroyed evidence and tried to portray the death as poisoning.

Section 3(5), Bharatiya Nyaya Sanhita, 2023 (Earlier Section 34 IPC)

Fixes joint liability when an offence is committed with a common intention.

Both accused acted together in carrying out the murder.

Section 111, Bharatiya Nyaya Sanhita, 2023 (Earlier Section 328 IPC)

Punishes administering a harmful or stupefying substance to facilitate an offence.

Sleeping pills were allegedly mixed into the victim’s food before the murder.

CASE DETAILS

Case Title: State v.
