Kerala High Court said No. holding that Section 498A IPC requires a legally valid marriage, and a live-in relationship alone cannot make a man the \u201chusband\u201d in the eyes of law.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>ERNAKULAM: <\/em>The <strong><a href=\"https:\/\/highcourt.kerala.gov.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kerala High Court<\/a><\/strong>, through <strong>Justice A. Badharudeen<\/strong>, quashed a <strong>Section 498A IPC<\/strong> case against a man after finding that the complainant was <strong>not his legally wedded wife<\/strong> but was only in a live-in relationship with him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The matter arose from an FIR registered at a police station in Kozhikode. The prosecution alleged that the complainant was in a <strong>live-in relationship<\/strong> with the accused from 13 March 2023 to 20 August 2023, and during that period, he mentally and physically harassed her.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The accused approached the High Court under <strong>Section 482 CrPC<\/strong> and argued that <strong><a href=\"https:\/\/www.shoneekapoor.com\/498a\/\" target=\"_blank\" rel=\"noreferrer noopener\">Section 498A IPC<\/a><\/strong> could not apply because there was <strong>no legal marriage<\/strong> between him and the complainant. His argument was simple: a live-in partner cannot automatically become a husband under criminal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Public Prosecutor also fairly submitted that the relationship between the parties was only a live-in relationship, and no material was brought to show any legal marriage between them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court relied on the settled legal position of the Supreme Court, where it was held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cFor a prosecution under S.498A IPC, there must be a valid marital relationship between the accused and the victim.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court then examined Section 498A IPC and noted that the provision applies only when a woman is subjected to cruelty by her husband or the relatives of her husband.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court referred to the statutory word \u201ccruelty\u201d under Section 498A IPC and explained that the offence requires a <strong>legally recognised marital relationship<\/strong>. Without marriage, the accused cannot be treated as husband for this section.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court made a very important observation:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cThe term \u2018husband @ hubby\u2019 means, a married man, woman\u2019s partner in marriage.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court further clarified:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cMarriage means a marriage in the eye of law.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It then explained the legal position in simple terms:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>\u201cThus, without a legal marriage, if a man becomes a woman\u2019s partner, he will not be covered by the term \u2018husband\u2019 for the purpose of Section 498(A) of IPC.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">On this basis, the High Court held that the accused was not the legally wedded partner of the complainant. Therefore, he could not be brought within the meaning of husband under Section 498A IPC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court found that the Magistrate had wrongly taken cognizance of the final report.
