The Court said No, and reiterated that a writ court is not an execution court; a spouse seeking recovery of unpaid maintenance must pursue the statutory execution mechanism before the competent forum.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>TAMIL NADU: <\/em>The Madurai Bench of the <strong><a href=\"https:\/\/hcmadras.tn.gov.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">Madras High Court<\/a><\/strong>, presided over by <strong>Justice Mummineni Sudheer Kumar<\/strong>, dismissed a writ petition filed by a wife who sought to <strong>prevent the release of her husband&#8217;s pension and other retirement benefits<\/strong> on the ground that he had allegedly failed to comply with maintenance orders passed in her favour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case was filed by Rajammal against the Tamil Nadu <strong>State Transport Corporation Employees Pension Fund Trust<\/strong>, the General Manager of the Tamil Nadu <strong>State Transport Corporation<\/strong>, and her husband, N. Tamilmani.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the wife, matrimonial disputes between her and her husband had resulted in several proceedings before the <strong>Family Court and Civil Court<\/strong>. She stated that maintenance orders had already been passed in her favour. However, she alleged that her husband had failed to comply with those orders. On that basis, she approached the High Court seeking a direction to the authorities <strong>not to release his pensionary and other service benefits<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After hearing the matter, the Court was not inclined to grant the relief sought by the petitioner. The Court observed that the dispute was essentially between a wife and her husband and that the <strong>writ jurisdiction of the High Court could not be used as a substitute for execution proceedings.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Mummineni Sudheer Kumar specifically observed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>&#8220;This Court cannot be converted as an Execution Court or a Family Court for resolving the disputes between the petitioner and the third respondent, who are wife and husband.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court further explained that if the wife had already obtained a maintenance order in her favour, the law provides a specific mechanism for enforcing such orders. Instead of invoking the writ jurisdiction of the High Court, she was required to approach the <strong>appropriate forum<\/strong> for execution of the maintenance order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court observed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>&#8220;If at all the petitioner succeeded in the maintenance case against the third respondent, it is for her to initiate execution proceedings or otherwise for execution of the said orders.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Court made it clear that a <strong>writ petition cannot be used as a shortcut for enforcing maintenance orders<\/strong> or settling matrimonial disputes between spouses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court further stated:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>&#8220;But, under no circumstances, the petitioner can be allowed to maintain the present writ petition either for execution of the orders passed in the maintenance case or to resolve the dispute between her and the third respondent.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">While examining the case, the Court also found that the authorities responsible for disbursing the pension had not violated any legal or constitutional right of the petitioner. The <strong>grievance raised by the wife was solely against her husband and not against the government authorities<\/strong> who were made parties to the writ petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court therefore held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong><em>&#8220;Absolutely, there is no legal or constitutional right of the petitioner that is infringed by the respondents 1 &amp; 2 and the entire grievance of the petitioner is only against the third respondent.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In view of these findings, the High Court concluded that the <strong>writ petition was not maintainable<\/strong> and declined to interfere with the pensionary benefits payable to the husband.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, the <strong>writ petition was dismissed<\/strong>.
