The case has been in national headlines ever since Twisha Sharma was found dead at her matrimonial home in Bhopal on May 12.

Police registered an FIR against Samarth Singh and his family under Sections 80(2) and 85 of the Bharatiya Nyaya Sanhita related to dowry death and cruelty, along with provisions of the Dowry Prohibition Act. Since then, the matter has become highly sensitive and widely discussed across social media and news platforms.

According to reports, Samarth Singh appeared before the Jabalpur District Court after withdrawing his anticipatory bail plea from the Madhya Pradesh High Court. Police later took him into custody and produced him before Judicial Magistrate First Class Anudita Gupta in Bhopal.

During the hearing, police demanded seven days’ custody. They argued that custodial interrogation was needed for “spot verification, seizure of additional evidence, and recording detailed statements.”

Police also claimed they wanted to investigate where Samarth Singh stayed during the last few days and whether anyone helped him while he was allegedly avoiding arrest.

Advocate Ankur Pandey, appearing for Twisha Sharma’s family, supported the police demand and argued that:

“Sustained interrogation was necessary to piece together the chain of evidence.”

On the other side, Samarth Singh’s lawyer Advocate Enos George Carlo opposed long police custody and argued that one day was enough because police had already seized important documents and evidence. The defence maintained that there was no need for extended custody.

The court finally accepted the police request and granted seven-day remand. The court also directed Samarth Singh to surrender his passport. Earlier, police had issued a lookout notice and announced a reward regarding his arrest.

The case has also created controversy because many people are questioning whether the investigation is being influenced by public pressure and media coverage even before trial begins. Supporters of Samarth Singh argue that allegations alone should not be treated as proof of guilt and that every accused deserves a fair investigation under law.

Meanwhile, the Madhya Pradesh High Court has issued notice on pleas challenging anticipatory bail granted to Samarth Singh’s mother, retired judge Giribala Singh. The High Court also directed a second post-mortem examination by a team of AIIMS Delhi doctors in Bhopal.

During the proceedings, reports claimed that Samarth Singh appeared calm inside the courtroom. Some people present there said he showed “no visible nervousness or remorse” and remained “calm and confident” throughout the hearing.

As the investigation continues, the case is now becoming an important test of whether the legal process will remain balanced and evidence-based instead of being driven by emotional narratives and public outrage.

Explanatory Table: Laws And Sections Involved

Law / Section

Purpose

How Applied In This Case

Section 80(2), BNS – Dowry Death

Punishes dowry death cases

Applied after Twisha Sharma’s death at matrimonial home

Section 85, BNS – Cruelty

Covers cruelty by husband or relatives

Police alleged harassment by husband and family

Section 3(5), BNS – Common Intention

Fixes joint liability on multiple accused

Used against husband and family members together

Section 3, Dowry Prohibition Act

Bans giving or taking dowry

Added over alleged dowry-related transactions

Section 4, Dowry Prohibition Act

Punishes dowry demand

Applied over alleged dowry demands

Anticipatory Bail

Protection from arrest before custody

Samarth Singh withdrew his plea

Police Custody Remand

Allows police interrogation in custody

Court granted 7-day police custody

Second Post-Mortem Order

Fresh medical examination

Ordered by High Court through AIIMS doctors

Case Details

Case Title: State vs Samarth Singh & Others

Court: Court of Judicial Magistrate First Class, Bhopal

Presiding Judge: JMFC Anudita Gupta

Main Accused: Samarth Singh

Other Persons Under Scrutiny: Retired Judge Giribala Singh (Mother of Samarth Singh)

Counsels:

Advocate Ankur Pandey: Appearing for Twisha Sharma’s family

Advocate Enos George Carlo: Appearing for Samarth Singh

Key Takeaways

Allegations alone are being treated like conviction even before trial and cross-examination begin.

Media pressure in dowry cases often destroys the presumption of innocence for husbands and in-laws.

Police custody and public outrage are moving faster than verified forensic conclusions in this case.

Every accused deserves a fair investigation, balanced reporting, and evidence-based prosecution under law.

Cases like this again raise concerns about misuse potential of dowry laws and instant criminalisation of entire families.

This Could Change Your Case-Get FREE Legal Advice-Click Here!

Disclaimer: The views and opinions expressed in this article are those of the Indian courts and do not necessarily reflect the official policy or position of “ShoneeKapoor.com” or its affiliates.
