{"id":7539,"date":"2026-05-11T15:18:13","date_gmt":"2026-05-11T09:48:13","guid":{"rendered":"https:\/\/www.shoneekapoor.com\/legal-news\/?p=7539"},"modified":"2026-05-11T14:49:48","modified_gmt":"2026-05-11T09:19:48","slug":"domestic-fight-death-not-murder-hc","status":"publish","type":"post","link":"https:\/\/www.shoneekapoor.com\/legal-news\/domestic-fight-death-not-murder-hc\/","title":{"rendered":"Stabbing Husband To Death During Domestic Fight Not Murder: Telangana High Court Reduces Wife\u2019s 4-Year Jail Sentence To \u20b9500 Fine"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-medium-font-size\">The Telangana High Court upheld the wife\u2019s conviction for stabbing her husband to death, but reduced her sentence to fine, calling it a spur-of-the-moment act.<\/h2>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\">Can a husband lose his life during a domestic fight and still see the case treated as \u201cnot murder\u201d?<\/h2>\n\n\n\n<p><em>TELANGANA<\/em>: The <strong><a href=\"https:\/\/tshc.gov.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">Telangana High Court<\/a><\/strong>, in a judgment delivered by <strong>Justice Tirumala Devi Eada<\/strong>, upheld the conviction of a woman for <strong>causing the death of her husband<\/strong> after stabbing him with a knife during a <strong>domestic dispute.<\/strong><\/p>\n\n\n\n<p>However, while maintaining her conviction, the Court ultimately reduced the punishment <strong>from four years imprisonment to only a fine of \u20b9500.<\/strong><\/p>\n\n\n\n<p>The case arose from an incident in Adilabad district where the husband allegedly went to the house of his wife\u2019s parents <strong>to meet his children<\/strong>. According to the Court records, the husband and wife had been <strong>living separately for nearly one month<\/strong> before the incident. The husband was reportedly staying with his mother, while the wife was residing with her parents.<\/p>\n\n\n\n<p>As per the prosecution, the husband had taken dates for his children and visited his wife&#8217;s house. During the visit, an argument allegedly broke out between him and the family members of his wife. Witnesses later informed the Court that <strong>loud quarrels and shouting<\/strong> were heard from inside the house shortly before the incident.<\/p>\n\n\n\n<p>One of the neighbours told the Court that he heard disturbance from the house and later heard the <strong>deceased shouting \u201cAmma\u201d in pain<\/strong>. When he came outside, he allegedly saw the husband lying with a <strong>serious neck injury<\/strong>.<\/p>\n\n\n\n<p>The mother of the deceased also stated before the Court that she received a phone call informing her that her son had been attacked. When she reached the spot, she found him <strong>lying dead with a major injury on his neck.<\/strong><\/p>\n\n\n\n<p>The postmortem report revealed that the husband had suffered a <strong>deep stab injury<\/strong> that <strong>damaged internal organs, ribs, blood vessels, and lungs.<\/strong> The doctor who conducted the postmortem confirmed that the death occurred because of the stab injury caused by a <strong>sharp weapon.<\/strong><\/p>\n\n\n\n<p>The prosecution also relied upon the recovery of the knife allegedly used in the attack. According to the Court, the knife was recovered after the wife herself showed police where it had been hidden inside the house.<\/p>\n\n\n\n<p>During the hearing, the defence argued that there were no direct eyewitnesses to the incident and claimed that the incident happened suddenly during a heated situation inside the house. The defence also argued that the wife had no intention to kill her husband.<\/p>\n\n\n\n<p>While examining the circumstances, the High Court noted that the husband had allegedly returned to the house in a <strong>naked condition<\/strong> and had abused the family members of his wife before the incident took place. The Court observed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cDuring the said quarrel the accused must have acted in a spur of anger and thus, has stabbed the deceased\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The Court further noted:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em><strong>\u201cKnowledge that the said act is likely to cause the death of the deceased is sufficient.\u201d<\/strong><\/em><\/p>\n<\/blockquote>\n\n\n\n<p>The High Court held that the wife clearly knew that stabbing a person with a knife could cause serious injury and death. Accordingly, the <strong>conviction against her was upheld<\/strong>.<\/p>\n\n\n\n<p>However, despite the husband losing his life in the incident, the High Court took a lenient view on punishment, considering the <strong>surrounding circumstances<\/strong> of the quarrel.
