Shillong court\u2019s latest order in the Raja Raghuvanshi case has triggered fresh legal debate.<\/h2>\n\n\n\n<p><em>SHILLONG<\/em>: In a controversial order dated 27 April 2026, <strong>Smt. D.R. Kharbteng<\/strong>, Additional Deputy Commissioner (Judicial), Shillong, granted bail to Sonam Raghuvanshi, accused in the <strong>brutal honeymoon murder<\/strong> of her husband Raja Raghuvanshi. The court relied mainly on procedural lapses in arrest rather than the seriousness of the allegations, raising serious legal and public concerns.<\/p>\n\n\n\n<p>The case relates to the recovery of Raja Raghuvanshi\u2019s body from a gorge in Meghalaya during a honeymoon trip. Sonam was <strong>arrested on 09.06.2025<\/strong> and has been <strong>in custody for over 10 months<\/strong>. The chargesheet was filed and even trial had started, with 4 witnesses already examined out of 90. Despite this progress, the trial stalled due to <strong>supplementary chargesheet and procedural delays.<\/strong><\/p>\n\n\n\n<p>The defence argued that the accused should not remain in custody for an unlimited period when the trial is delayed and that speedy trial is a legal right. It also challenged the <strong>legality of the arrest<\/strong>, claiming <strong>proper grounds of arrest were never communicated<\/strong>.<\/p>\n\n\n\n<p>The prosecution strongly opposed bail. It argued that this was already the <strong>fourth bail application<\/strong> and such objections were raised very late, after charges had already been framed. It also said the accused had signed arrest papers and there was <strong>enough material to show that grounds of arrest were communicated.<\/strong><\/p>\n\n\n\n<p>Despite this opposition, the Shillong court carefully examined the arrest records and found major inconsistencies. The documents repeatedly mentioned <strong>wrong legal sections<\/strong> and did not clearly communicate the actual murder charge to the accused. The court specifically observed that<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u201cThere is no indication that the charges against her has been communicated to her.\u201d<\/h3>\n\n\n\n<p>The court relied on Supreme Court rulings dealing with Article 22(1) of the Constitution. Referring to <strong><em>Vihaan Kumar v. State of Haryana<\/em><\/strong>, the court noted that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cThe requirement of informing a person arrested of grounds of arrest is a mandatory requirement of Article 22(1).\u201d<\/em><\/strong><em><\/em><\/p>\n<\/blockquote>\n\n\n\n<p>After examining the documents, the court held that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cSufficient knowledge of facts constituting grounds of arrest, has not been effectively communicated to the petitioner herein in clear terms.\u201d<\/em><\/strong><em><\/em><\/p>\n<\/blockquote>\n\n\n\n<p>The court also found that this failure had prejudiced the defence of the accused. It finally concluded that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cThe petitioner has been able to make out a case of not having been effectively communicated the grounds of arrest upon her arrest.\u201d<\/em><\/strong><em><\/em><\/p>\n<\/blockquote>\n\n\n\n<p>On this basis, bail was granted subject to conditions that the accused must <strong>attend court regularly, must not abscond, must not tamper with evidence or witnesses, and must not leave jurisdiction without permission<\/strong>.
