{"id":6846,"date":"2026-04-15T17:39:18","date_gmt":"2026-04-15T12:09:18","guid":{"rendered":"https:\/\/www.shoneekapoor.com\/legal-news\/?p=6846"},"modified":"2026-04-15T17:35:22","modified_gmt":"2026-04-15T12:05:22","slug":"engineer-wife-40k-maintenance-hc","status":"publish","type":"post","link":"https:\/\/www.shoneekapoor.com\/legal-news\/engineer-wife-40k-maintenance-hc\/","title":{"rendered":"Wife\u2019s Engineering Degree Irrelevant Without Proof of Income: MP High Court Upholds Husband\u2019s Liability to Pay \u20b940,000 Maintenance Under Section 125 CrPC"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-medium-font-size\">The Madhya Pradesh High Court says a wife cannot be denied maintenance after leaving work due to marital obligations.<\/h2>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\">When \u201cmarital obligations\u201d justify a wife not working, why does the same standard not protect a husband facing financial hardship?<\/h2>\n\n\n\n<p><em>JABALPUR: <\/em>In a judgment dated 23.03.2026, the <strong><a href=\"https:\/\/mphc.gov.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">Madhya Pradesh High Court<\/a><\/strong>, presided over by <strong>Justice Gajendra Singh<\/strong>, rejected a husband\u2019s <strong>revision petition<\/strong> challenging the <strong><a href=\"https:\/\/sahodar.in\/maintenance-its-types-under-crpc-sec-125-sec-24-25-hma\/\" target=\"_blank\" rel=\"noreferrer noopener\">maintenance<\/a> order<\/strong> directing him to pay \u20b940,000 per month to his wife under <strong>Section 125 CrPC<\/strong>.<\/p>\n\n\n\n<p>The case arose after the Family Court awarded maintenance to the wife from the date of application, despite the husband arguing that she was <strong>highly educated and capable of earning<\/strong>. He claimed that she was a <strong>qualified engineer<\/strong> and <strong>working through freelancing<\/strong>, and therefore should not be dependent on him financially.<\/p>\n\n\n\n<p>The wife, on the other hand, stated that she had no stable source of income and had left her job due to <strong>marital responsibilities and circumstances<\/strong>. She also alleged <strong>cruelty and financial demands<\/strong> during the marriage. The husband denied all allegations and attempted to show that she had <strong>sufficient financial resources and qualifications to support herself<\/strong>.<\/p>\n\n\n\n<p>While examining the case, the Madhya Pradesh High Court noted clear gaps in the husband\u2019s defence. Although he claimed that the wife was earning, he failed to provide any concrete proof of her actual income. At the same time, the Court also observed that the husband himself did not place proper documentary evidence regarding his own earnings.<\/p>\n\n\n\n<p>The Court stated that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>&#8220;There is difference between &#8216;may earn&#8217; and &#8216;is earning&#8217;\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>This observation became the central reasoning of the judgment. The Court clarified that simply having qualifications or the ability to earn does not mean that a person is actually earning at present.<\/p>\n\n\n\n<p>The Court further held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>&#8220;There is no evidence that the wife is earning. The awarded amount is proportionate to the standard as the husband who previously worked in United Kingdom and now working as Assistant Manager in Genpact Pvt. Ltd. an American Company is expected to provide to his wife.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>This effectively placed the <strong>financial responsibility<\/strong> on the husband in the absence of proof of the wife\u2019s earnings.<\/p>\n\n\n\n<p>On financial claims, the Court clarified:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>&#8220;&#8216;Streedhan&#8217; is an absolute property of a woman. No plea can be raised that &#8216;Streedhan&#8217; is with the wife.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The <strong>revision<\/strong> <strong>petition was dismissed,<\/strong> with limited liberty given to the husband:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>&#8220;The revision petitioner is at liberty to approach before the learned Family Court under Section 145 of BNSS, 2023 for modification of the order either the wife gets job or any other change of circumstance occurs.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The ruling again reflects that unless a husband can strictly prove the wife\u2019s actual income, the burden of maintenance continues to remain on him, even where the wife is qualified and capable of earning.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Explanatory Table Of Laws &amp;
