The answer may surprise many facing similar cases.<\/strong><\/strong><\/h2>\n\n\n\n<p><em>DV Case Dismissed for Lack of Evidence: <\/em>The Court of <strong>Shri Vishwanath Savadi, Judicial Magistrate First Class<\/strong>, Bengaluru, has dismissed a petition filed under <strong>Section 12 of the Protection of Women from Domestic Violence Act, 2005<\/strong>. The judgment dated 27 January 2025 brings significant relief to the husband, as the Court held that the allegations were <strong>not proved by proper evidence.<\/strong><\/p>\n\n\n\n<p>The wife had alleged <strong>cruelty, dowry harassment, physical assault, emotional abuse and economic neglect<\/strong>. She claimed that she was subjected to domestic violence and was denied financial support. On this basis, she sought multiple reliefs under the <strong><a href=\"https:\/\/matrimonialadvocates.com\/?s=Domestic+Violence+Act\" target=\"_blank\" rel=\"noreferrer noopener\">Domestic Violence Act<\/a><\/strong>.<\/p>\n\n\n\n<p>During the trial, the wife was examined as PW.1 and cross-examined five times, but she <strong>failed to appear<\/strong> thereafter to complete the process. Despite repeated opportunities, her continued absence led the Court to treat her further cross-examination as \u201cnot tendered.\u201d<\/p>\n\n\n\n<p>The Court observed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cCross-examination is an essential process for assessing the credibility of a witness.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The judgment further stated that the petitioner\u2019s absence prevented the respondent from properly challenging her claims. The Court noted that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cThe petitioner\u2019s failure to appear for further cross-examination can be perceived as an attempt to avoid scrutiny.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The Court also highlighted that fairness in trial requires equal opportunity to both sides. It recorded that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cThe legal principle of fairness requires that both parties have the opportunity to fully examine and cross-examine witnesses.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Since the testimony remained incomplete, the Court found that the reliability of the allegations became doubtful.<\/p>\n\n\n\n<p>Most importantly, the Court examined whether the wife had proved domestic violence as defined under the law. The Magistrate clearly held that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cThe evidence on record does not sufficiently establish that the petitioner experienced verbal, emotional, or economic abuse as defined under Section 3 of the PWDV Act.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The Court also found that there was no convincing evidence that the husband had neglected to provide financial support. Due to lack of strong and consistent evidence, the Magistrate concluded that the allegations were not legally proved.<\/p>\n\n\n\n<p>The Court ultimately dismissed the petition, stating:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>\u201cThe petition filed by the petitioner under Section 12 of the Protection of Women from Domestic Violence Act is hereby dismissed.\u201d<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>All pending interim applications were also disposed of.<\/p>\n\n\n\n<p>The ruling makes it clear that allegations alone are insufficient.
