The Court said forcing a woman to repeatedly visit court to secure her husband\u2019s acquittal would amount to harassment and defeat the ends of justice.<\/strong><\/h4>\n\n\n\n<p><em>PRAYAGRAJ<\/em>: The <strong>Allahabad High Court<\/strong> quashed the entire criminal case, including the charge sheet and cognizance order against Farrukhabad resident <strong>Ashwani Anand<\/strong>, who was accused of kidnapping and offences under the <strong><a href=\"https:\/\/www.shoneekapoor.com\/what-is-pocso-act-and-how-is-it-interpreted-by-indian-courts\/\" target=\"_blank\" rel=\"noreferrer noopener\">POCSO Act<\/a><\/strong>.<\/p>\n\n\n\n<p>The Court held that continuing such a case would cause <strong>unnecessary harassment<\/strong> to the girl, who is now his legally wedded wife.<\/p>\n\n\n\n<p>The judgment, delivered by <strong>Justice Kshitij Shailendra<\/strong>, said that compelling a woman to keep appearing in court for months or years only to help her husband get acquitted, especially when she has already denied all allegations on oath, would expose her to avoidable social stigma, financial burden, and indignity.<\/p>\n\n\n\n<p>Quoting the court:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>&#8220;Compelling a lady in such matters to visit court premises for months and years for the purposes of getting her own husband acquitted where he is facing threat of punishment for doing some wrong with his wife which she does not admit, would be an instrument of harass.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p><strong>What Led To The Case<\/strong><\/p>\n\n\n\n<p>The FIR was filed on 23 April 2024 by the girl\u2019s father alleging that the applicant had kidnapped his daughter. Police investigated and filed a charge sheet on 30 September 2024. Cognizance was later taken on 8 April 2025 for offences under <strong>Sections 363, 366 IPC and Sections 11\/12 of the POCSO Act<\/strong>.<\/p>\n\n\n\n<p>However, the girl completely denied all allegations at every stage:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In her <strong>Section 161 CrPC<\/strong> statement (16 August 2024), she said she had left home voluntarily, stayed at a girls\u2019 PG in Ghaziabad, and had <strong>no physical relationship<\/strong> with the accused.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In her <strong>Section 164 CrPC \/ Section 183 BNSS<\/strong> statement, she stated she was <strong>20 years old<\/strong>, though her Aadhaar showed 17.<\/li>\n<\/ul>\n\n\n\n<p>Her mother also told the police that she no longer wished to remain in any relationship with her daughter due to her intimacy with the applicant.<\/p>\n\n\n\n<p>Later, the girl filed her <strong>own affidavit before the High Court<\/strong>, clearly supporting the quashing plea and stating the allegations were false.<\/p>\n\n\n\n<p><strong>Marriage Changed The Circumstances<\/strong><\/p>\n\n\n\n<p>The Court found it undisputed that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The couple <strong>married on 23 June 2025<\/strong>, after the girl attained the age of majority.<\/li>\n\n\n\n<li>The marriage was <strong>registered<\/strong> on 24 June 2025 under the UP Marriage Registration Rules, 2017.<\/li>\n\n\n\n<li>The marriage certificate was filed with the Court.<\/li>\n<\/ul>\n\n\n\n<p>Since both were now living together as husband and wife, the applicant argued that continuing the prosecution served no purpose, especially when the so-called victim herself wanted the case closed.<\/p>\n\n\n\n<p><strong>State\u2019s Objection: POCSO Is Non-Compoundable<\/strong><\/p>\n\n\n\n<p>The State strongly opposed quashing, arguing that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>POCSO offences are serious and <strong>non-compoundable<\/strong><\/li>\n\n\n\n<li>They are \u201coffences against society\u201d, not just against an individual<\/li>\n\n\n\n<li>Subsequent marriage cannot wipe out the offence<\/li>\n<\/ul>\n\n\n\n<p>They relied on <strong>K. Kirubakaran v. State of Tamil Nadu (2025)<\/strong>.<\/p>\n\n\n\n<p><strong>Why The High Court Rejected The State\u2019s Argument<\/strong><\/p>\n\n\n\n<p>The Court clarified that the Kirubakaran case involved a <strong>conviction after trial<\/strong>, whereas in the present matter, the case was still at the <strong>pre-trial stage<\/strong>, with even the charges not framed yet.<\/p>\n\n\n\n<p>It further noted that the Supreme Court itself had said the Kirubakaran judgment <strong>must not be treated as precedent<\/strong>, quoting:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cNeedless to observe, this order is rendered in the unique circumstances that have unfolded before us and shall not be treated as precedent for any other case.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The Court instead relied on Supreme Court judgments such as <strong>K. Dhandapani<\/strong>, <strong>Mafat Lal<\/strong>, <strong>Dasari Srikant<\/strong>, and <strong>Mahesh Mukund Patel<\/strong>, all of which recognized that continuing prosecution after the woman marries the accused and denies allegations on oath does not serve justice.<\/p>\n\n\n\n<p>In <strong>Dasari Srikant<\/strong>, the Supreme Court held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>&#8220;The affirmation of the judgment \u2026 would have the disastrous consequence on the accused appellant being sent to jail which in turn could put his matrimonial relationship with the complainant in danger.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p><strong>Court\u2019s Reasoning: Justice Over Procedure<\/strong><\/p>\n\n\n\n<p>Justice Shailendra emphasized that inherent powers under <strong>Section 528 BNSS<\/strong> must be used to ensure justice and prevent misuse of the judicial process.
