When the system was weaponized against him, he chose to fight, not fear.<\/p>\n\n\n\n<p>With <strong>IV tubes in his arm he walked miles inside hospitals<\/strong> and with steel in his spine he walked into the Supreme Court of India with truth as his only weapon. His journey sends a clear message to every man suffering in silence: injustice may try to break you, but courage will always rebuild you stronger.<\/p>\n\n\n\n<p>He was honoured for his extraordinary courage in defeating a series of false criminal cases filed against him a battle he fought while simultaneously surviving many challenges.<\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong><span style=\"text-decoration: underline\">Background Of The Case<\/span><\/strong><\/p>\n\n\n\n<p>Former Army Intelligence Officer (G3 Intelligence \u2014 350 Brigade) diagnosed with cancer in 2017, suffered cardiac arrest during treatment and his wife underwent major brain surgery.&nbsp; Despite doctors giving him 3\u20134 months to live, he continued collecting evidence and preparing his legal defence.<\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong><span style=\"text-decoration: underline\">Allegations Raised Against Him<\/span><\/strong><\/p>\n\n\n\n<p>Several fabricated FIRs and complaints were filed, allegedly:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>By people known to him<\/li>\n\n\n\n<li>Including professionals involved in conspiracy<\/li>\n\n\n\n<li>With no specific incidents, no direct evidence, and contradictory statements<\/li>\n<\/ul>\n\n\n\n<p>He was:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wrongfully named as an accused<\/li>\n\n\n\n<li>Not arrested<\/li>\n\n\n\n<li>Yet falsely shown as refusing cooperation, withholding evidence, etc.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-center\"><strong><span style=\"text-decoration: underline\">Proceedings Before Lower Courts<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Multiple charge sheets were filed without proper verification<\/li>\n\n\n\n<li>Trial courts kept the matter pending for long<\/li>\n\n\n\n<li>The officer himself discovered similar false charge sheets filed by the same complainant against different people<\/li>\n\n\n\n<li>He personally presented those documents in court: Proving a pattern of legal abuse and misuse of arrest threat for coercion, pressure and harassment.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-center\"><strong><span style=\"text-decoration: underline\">Powerful speech he gave at Ekam Nyaay Conference<\/span><\/strong><\/p>\n\n\n\n<p>Even when doctors told him he had \u201c3\u20134 months to survive\u201d, Captain responded:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cI give myself 30 years more to live \u2014 I guarantee you that.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>With IV pipes in his arms during cancer treatment, he kept walking:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201c<strong>10,000 steps every single day in the hospital. I said I won\u2019t quit.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Captain Rakesh Walia discovered wrongful charge sheets, doctored allegations, and a coordinated conspiracy:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cThere is a group working around Delhi-NCR. A lawyer. A doctor. Five others. All coordinated. All false.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>When lower courts overlooked contradictions, he remained fearless:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cPut aside the law for a moment if you are innocent, the truth will rise.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"has-text-align-center\"><strong><span style=\"text-decoration: underline\">Supreme Court: The Turning Point<\/span><\/strong><\/p>\n\n\n\n<p>On the day his senior counsel couldn\u2019t appear, he decided only a soldier could make:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cMy Lord, I will present my case myself.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The courtroom fell silent.He placed multiple false charge sheets filed by the same complainant before the Bench.<\/p>\n\n\n\n<p>The judge asked the State:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cHave you verified these charge sheets?\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The State admitted:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cIt is not six, My Lord\u2026 it is eight.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Captain recalls:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cEverybody knew it. The investigators knew it. But nobody stopped it.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>He was not fighting strangers. He was fighting those who once claimed closeness.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201c<strong>These things are done by people who know you very well.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>His wife suffered a severe brain injury. He survived two major medical battles. His family was shaken but standing.<\/p>\n\n\n\n<p>He told the young men present:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201c<strong>Do not lose your head when the storm comes. Get up and fight. Fight for your truth. Nobody can destroy an innocent man unless he chooses to give up.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>He quoted the Mahabharata:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cKrishna didn&#8217;t remove the war. State of NCT of Delhi &amp; Anr.<\/strong>, the apex court stepped in to quash FIR No. 766\/2021 registered at Mehrauli Police Station (South Delhi) under Sections 376, 377, 328 and 506 IPC.<\/p>\n\n\n\n<p>Rakesh Walia \u2013 a retired Army officer and published author \u2013 had been accused by a 39-year-old woman of being drugged with a cold drink during a meeting for a modelling assignment, and then raped and molested. The allegation was that she met him on 29 December 2021 at around Chhatarpur Metro Station, joined his car, consumed a spiked drink and lost consciousness, after which the assault occurred.<\/p>\n\n\n\n<p>However, on a deep dive of the facts, the Court found a striking pattern:<\/p>\n\n\n\n<p><strong>The complainant had filed at least eight (nine including this) similar FIRs across multiple police stations in Delhi over the past eight years<\/strong>, <strong>accusing different men of sexual offences under various IPC sections.<\/strong><\/p>\n\n\n\n<p>Moreover, she failed to cooperate in the investigation &#8211; she did not attend court despite service of notice and did not submit key forensic evidence or undergo medical tests in some instances.<\/p>\n\n\n\n<p>The Delhi High Court had earlier declined to quash the proceedings under Section 482 Cr.P.C (now Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023). <strong>The matter reached the Supreme Court via a Special Leave Petition (SLP (Crl.) No. 14850\/2024).<\/strong><\/p>\n\n\n\n<p>On 25 February 2025, a Bench of <a href=\"https:\/\/www.shoneekapoor.com\/legal-news\/?s=Justices+Sudhanshu+Dhulia\" target=\"_blank\" rel=\"noreferrer noopener\">Justices Sudhanshu Dhulia<\/a> and K. Vinod Chandran held that the case against RskeaWalia constituted <strong><em>\u201cnothing but an abuse of the process of law\u201d<\/em><\/strong>.<\/p>\n\n\n\n<p>They observed that the High Court should have exercised its inherent power to quash the FIR at an earlier stage, given the manifest misuse of legal machinery evident in this record.
